Police were called out to reports of a noisy party on the twelfth floor of Jumples Court in Mixenden, Halifax, just after midnight on Saturday February 18th.
The occupier agreed to end the party and police remained as people left and that is when 18 year old Christian Lee climbed over the balcony as others were leaving and sadly fell to his death.
While the matter was referred to the Independent Police Complaints Commission (IPCC), the investigation remains with West Yorkshire Police to continue.
Detective Chief Inspector Simon Atkinson, of West Yorkshire Police's Homicide and Major Enquiry Team, said: "It is a terrible tragedy and our thoughts are with the family and friends of Christian.
"It is not clear why he climbed over the balcony and this is the focus of the investigation.
