RULES
The following rules (“Rules”) together with Global Radio’s ("Global Radio") general and competition terms and conditions (the “Terms and Conditions”) which can be found here apply to The Big Chill radio competition ("the Competition") which will run from 4th July to 8th July (“the Duration”). The "Radio Station" is Capital FM Birmingham.
Anyone who enters the Competition (an “Entrant”) will be deemed to have understood these Rules along with the Terms and Conditions and will be bound by them. The Terms and Conditions are available on request from the Radio Station.
Details of the Competition:
To enter the Competition an Entrant must send a text message to 82122 (the “Text Message Line”). Text messages will be charged at standard network rates.
Entrants will be asked to text the word DRAW to 82122 to win. Text lines will be open for 5 minutes. The start time will be stipulated by the presenter.
An entry will be chosen at random from all eligibility entries.
All entrants will be required to talk to the presenter/s and a call will be recorded with the presenter/s and played on-air. If entrants fail to answer their phone, answer their phone but fail to be available shortly thereafter to record a call, or if any fault occurs immediately prior to or during these calls and it is not possible to re-establish contact with the caller, another contestant will be selected at random. If the caller is driving at the time of the call and is unable to pull over, or cannot continue the call for any reason, the call may be terminated and another entrant selected.
Eligibility:
Resident in the United Kingdom, be able to comply with all the T&C’s and be at least 18 years old.
You must not be an employee, agent or a director of, or a member of the family of an employee, agent or director of:
(a) Us or any of our associated companies or subsidiaries; or
(b) any advertising agency or web company connected with Us.
You can only enter this Prize Draw once. No third party entries, bulk entries or entries submitted by agents will be accepted.
Festival Republic Ltd reserves the right to verify the eligibility of entrants. Festival Republic Ltd may request such information as it considers reasonably necessary for the purpose of verifying the eligibility of an entrant and the prize may be withheld until and unless Festival Republic Ltd is satisfied with the verification.
Prize:
Daily winners will receive 2 x weekend passes (total value £330) plus return coach travel for two people to the festival site. The pick-up and drop off location is Birmingham Coach Station, Mill Lane, Digbeth, Birmingham B5 6DB. The winner pays for own travel to the pick-up location and for return travel from the drop off location to home. The prize is ONE PAIR (2 tickets) of weekend tickets with access to the campsite. The prize CAN be exchanged for a pair of day tickets, or a pair of 2-day tickets for the Fri/Sat or Sat/Sun (see http://www.bigchill.net/festival/info/tickets for details of day/two-day ticket options). However, the free coach travel to the site is ONLY available on the THURSDAY 4th OR FRIDAY 5TH AUGUST and free coach return is MONDAY 8TH AUGUST ONLY*. TRAVEL OUTSIDE OF THESE DATES WILL BE AT THE COST OF THE WINNER.
No cash alternative, tickets cannot be transferred, winner pays for all other expenses (meals, accommodation (access to a campsite is provided but the winner will need to bring their own tent etc), drinks) other than coach travel with National Express and entry to the festival. Festival tickets and an e-ticket for the coach travel will be sent out to the winner in advance of the festival which runs from Thursday 4th August to Sunday 7th August.
*NOTE RE COACH TRAVEL TIMES:
Thursday 4TH or Friday 5TH August departs Birmingham coach station 1.00pm, arrives at the Big Chill 2.30pm
Return: Monday 8 August. Departs the Big Chill 9.00am, arrives Birmingham 10.30am
Where for reasons outside of our reasonable control We are unable to deliver to the winner the whole or any part of the Prize We shall have the right to decide on and substitute all or part of the Prize offered for any alternative which We may nominate.
The winner and any permitted companion will be solely responsible for their own accommodation and all other expenses related to the Prize. Festival Republic Ltd assumes no responsibility for and shall not be liable in respect of any costs, charges, expenses or taxes which a winner may be required to pay at any time in connection with the Prize. The winner and any permitted companion shall at all times be subject to the any ticket terms and conditions and venue rules related to the Prize.
You agree that if you are a winner:
1. You consent to Us using your name and/or image in Our publicity for the Prize Draw and in such promotional materials as We see fit whether now or in the future, anywhere in the world;
2. you agree that We will be the owner of the intellectual property rights in your entry and to this end you will assign to Us, with full title guarantee, all intellectual property rights in your entry;
3. you will waive all moral rights in your entry;
4. you consent to the exploitation by Us (or any third parties We authorise) of your entry in any way We see fit and in any media;
5. you agree that you will not be entitled to any payment for such use;
6. you will sign such documents as We reasonably request to confirm the foregoing; and
7. you will retain a copy of your entry as, unfortunately, we are unable to return them.
LIMITATION OF LIABILITY
1. We (Festival Republic Ltd) cannot be held responsible for any costs incurred by you in entering the Prize Draw (whether or not such entry is successful) or in relation to you taking part in the Prize Draw.
2. We will not be responsible for any losses you suffer as a result of Our breach of these Terms and Conditions unless those losses were reasonably foreseeable to both you and Us at the date you enter the Prize Draw.
3. For the avoidance of doubt, We will not be liable to you, in contract, tort (including, without limitation, negligence) or otherwise in connection with the Prize Draw for:
(a) loss of revenues, profits, contracts, business or anticipated savings or loss of data; or
(b) any loss of goodwill or reputation; or
(c) any special or indirect or consequential losses;
however caused.
4. Nothing in these Terms and Conditions shall exclude or limit Our liability:
(a) for death or personal injury resulting from Our negligence or a deliberate act or omission of Ours or any of Our officers, employees or agents;
(b) for fraudulent misrepresentation; or
(c) to the extent that such liability cannot by law be excluded or limited.
5. We will not be liable for any damages or losses as a result of failure by Us to deliver the Prize Draw, the Prize or any other prizes as a result of any circumstances outside of Our direct and reasonable control including, but not limited to, as a result of a server failure (including but not limited to access delays or interruptions, data non-delivery or mis-delivery), any act(s) of God, war or terrorism, breaches of security or unauthorised use of personal data arising from hacking and/or failure or lack of reception of telephone or mobile telephone networks.
