Clean & Clear's terms and conditions for the second burst of their promotion which is hosted on Capital.

Terms and Conditions

1.    The Real You Matters Competition (“the Competition”) is open to residents of England, Scotland and Wales only (excludes Isle of Man, Channel Islands, Northern Ireland and Republic of Ireland) who are aged 13 years old or over on the date of entry to the competition, except employees (and their families) of Johnson & Johnson Limited and its affiliated companies, their agencies and anyone professionally connected with this Competition.

2.     Starting and Closing Date: The Competition will be live from 21st July 2014 (the "Starting Date") until 5:00 PM BST on 1st September 2014 (the "Closing Date"). Entries received after the closing date of 5:00 PM BST on 1st September (the "Closing Date") will not be accepted.

3.    Mechanics for Entry: The Competition can be entered by submitting a photo or video of what really matters to you to the CLEAN & CLEAR® Facebook Application either by visiting www.seetherealmecompetition.co.uk or via the Capital FM website (www.capitalfm.com/win). It could be a picture of your favourite hobby, unusual interest, adorable pet or lucky charm!

Jury Panel

4.     After the Closing Date, all entries will be judged by a panel ("Jury Panel") composed of one employee of Johnson & Johnson Limited, one employee of Johnson & Johnson’s creative agency and one independent member. The Jury panel will select one entrant as the winner and one hundred entries as runners-up. The winner will be the entry that is considered to most innovatively express their true personality through their hobbies, interests and other things that matter to them. All winners will be notified by e-mail by 12/09/2014.

5.    Full names of the Jury Panel can be obtained by sending an email to crc@its.jnj.com or by sending a stamped addressed envelope to Clean & Clear Team, Johnson & Johnson Ltd, Foundation Park, Maidenhead, SL6 3UG within 3 months of the Closing Date. The Promoter's decision on all matters regarding this Competition is final. No correspondence will be entered into.

First Prize Details

6.    The first prize winner will receive 1 day and 1 night in London for themselves and 3 friends (who are aged 13 years old or over on the date of the winner’s entry to the competition), including a tour of Capital FM in London’s Leicester Square, the chance record your own pop video, a professional hair and makeup session, TopShop Personal Style Advisor and £125 TopShop vouchers each, dinner at a top London restaurant and an overnight stay in a 4* London hotel. The winner only will also receive an Apple iPad Mini 16gb with wifi and retina display. Travel to and from London, a chauffeur within London and a £25 lunch allowance per person is also included.

7.     If the winner and/or any of their accompanying friends are under 18 years old, they must be accompanied by an adult over the age of 21. The adult will be expected to accompany the winner and their friends on the trip and will be able to take part in the guided tour of the Capital FM studios and the restaurant dinner and they will also receive the lunch voucher and the same travel arrangements.

8.    All prizes must be claimed and have been redeemed by the prize winner within 12 months of the date of initial correspondence with them. The first prize must be taken over a weekend or during school holidays but excludes the Christmas and New Year period (22nd December 2014 to 2nd January2015), Valentines Day (14th February 2015), Easter (3rd to 6th April 2015) and/or any UK Bank Holidays. Travel is subject to availability at the discretion of the Promoter. Travel will be by train, must be off peak and booked 4 weeks in advance.

9.     The private chauffer will be for a maximum of 8 hours per day around Central London / Zone 1 - 2 only for a maximum of 2 days in total.

10. The Hotel provided is classed as a 4 star deluxe and is based on the winner and 3 friends sharing two twin rooms and the accompanying adult staying in a single room all with ensuite facilities on a bed and breakfast basis.

11. The pop video experience lasts approximately 4 hours. The MAC make-up lesson lasts approximately 90 minutes. Hair styling takes approximately 30 minutes and can be chosen from 12 different styles. All activities must be booked in advance and are subject to availability.

12. Personal Style advisor must be booked 4-6 weeks in advance.

13. The winner and 4 people will enjoy a 3 course meal from a set menu and a soft drink each. Reservation cannot be booked more than 1 calendar month in advance.

14. Should the iPad Mini 16GB with wifi and retina display be unavailable at the time of purchase, NDL Group reserves the right to substitute with an alternative of equal or greater value. Specifications are subject to change.

15. All prizes must be claimed and booked by the prize winner within 12 months from the date of our initial correspondence with them.


16.    Proof of age for the winner and the winner’s accompanying friends will be required before first prize can be awarded.

Runner-up Prizes

17.  In addition to the first prize, there are 100 runner-up prizes of a CLEAN & CLEAR® product goodie bag available. The CLEAN & CLEAR® product goodie bag consists of a CLEAN & CLEAR® branded make-up bag containing a selection of 5x Clean & Clear products.

PR

18.     By participating entrants are deemed to agree that:

(a) their first name, photo or video and any associated explanatory text may be shown on the Gallery page of the CLEAN & CLEAR® Facebook application which can be viewed either by visiting www.seetherealmecompetition.co.uk or via the Capital FM website (www.capitalfm.com/win).

(b) their entry may be included and featured in a photo/video montage to be shown on Facebook, YouTube and other media after the Closing Date. The Promoter will, at its discretion, choose its favourite entries to include in the photo/video montage and shall not be able to showcase all photos/videos.

(c) their picture or video and story may be used for any future marketing and PR purposes by the Promoter, including on the CLEAN & CLEAR® Facebook page and YouTube channel for up to 12 months following the end of this Competition.

Use of Personal Data

19. Entrants Personal Data shall be used by the Promoter for the following purposes:

(a) To administer the Competition itself, for example, contacting the Prize Draw winners to arrange receipt of the Prize

(b) For future communications and promotions about the CLEAN & CLEAR® brand where the Entrant has opted to receive such communications from the Promoter. Participants may withdraw their consent to receiving such communications at any time by sending an email to cleanandclear@its.jnj.com.

(c) The Promoter, or its agent, may contact Entrants by email to request participation in future marketing or PR initiatives if the Entrant has opted in to receive such emails. It will be entirely at the discretion of the Entrant whether or not to take part and full details of the initiative will be shared with the Entrant in advance.

(d)    The Entrant understands and consents to their photo or video being open to others to view in the competition gallery on the CLEAN & CLEAR® Facebook page.

(e) In the event that any Adverse Event or product quality complaint is reported as a result of this Promotion, any related photo or video, story and personal data will need to be retained by the Promoter indefinitely for legal reasons.

20. Any use by the Promoter or its agents of Entrants Personal Data will be in accordance with the Promoter's and Privacy Policy.

21. should not submit photos or videos of anyone other than themselves or photos where anyone other than themselves  features.  Photos or videos showing identifiable images of anyone other than the entrant themselves will be deemed invalid and will prevent the entrant from continuing to participate in the Competition.  

Moderation

22. All Material will be pre-moderated by the Promoter before being entered into the Competition and displayed on the Gallery of the CLEAN & CLEAR® Facebook application. Other Facebook users will have the opportunity to view all Material that is displayed within the Gallery either within the CLEAN & CLEAR® Facebook application or on the Capital FM website. The Promoter endeavours to make entries appear on Application within a reasonable timeframe however moderation times may vary due to high volume of entries.

23. Any Material deemed inappropriate, incomplete, incorrect or unsuitable, in the Promoter's sole discretion, will be disqualified from the Competition and will not appear on the Gallery of the CLEAN & CLEAR® Facebook Application. Inappropriate and unsuitable Material includes, but is not limited to:

a) pornographic or "off-colour" Material,

b) political content or propaganda,

c) obscene, sexual, profane, lewd, or otherwise offensive Material,

d) nudity

e) music of any kind

f) car license plates, phone numbers or personal addresses

g) website or web page links,

h) derogatory characterizations of any ethnic, racial, sexual or religious groups,

i) any third party materials that may otherwise violate or infringe (or may infringe) copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable,

j) any Material that infringes or violates someone else's rights or the law,

k) any content or performance that has been broadcast or streamed, published or televised on television or as part of a recording of a motion picture film or television programme,

l) Material that is not of satisfactory quality (i.e. brightness, focus, volume) to be streamed online

m) Material defaming or invading publicity rights or privacy rights of any person, living or deceased, or otherwise infringing upon any person's personal or proprietary rights,

n) Material containing Adverse Events regarding use of the Promoter's, or its Affiliates' products, drugs, or devices (Adverse Events means any unexpected or unfavourable symptoms associated with the administration or use of a product, including overdose, abuse/misuse of a product, withdrawal symptoms or lack of efficacy).

o) Material containing off-label use of the Promoter's or its affiliated companies' products, drugs or devices.

p) Material which shows clothing or other objects showing visible logos, drawings, cartoons, phrases, trademarks or other third-party materials.

q) Material which does not comply with the competition theme

General Terms and Conditions

24. Withholding of Prizes: The Promoter retains sole discretion to withhold prizes without liability if in its view a winner is ineligible, the entry is invalid or entrant winner does not meet the necessary requirements as set out in these terms and conditions. The Promoter reserves the right to withdraw or amend the Competition in the event of unforeseen circumstances or circumstances outside of its control.

25. Liability: To the extent permitted by law, the Promoter excludes all liability whatsoever in connection with the Competition and the Prizes and in particular does not accept responsibility for entries invalidated by technical problems beyond the control of the Promoter or problems with accessing the Capital FM website or Facebook.

26. No endorsement: Capital FM, TopShop, MAC, Apple and iPad Mini are trademarks of their respective owners. The Promoter does not claim any rights in such trademarks and the Competition is not associated with or endorsed or supported by any of such trademark owners. The Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. You are providing your information to the Promoter and not to Facebook. By entering into this Promotion and Prize Draw participants hereby release Facebook from any connection to, or liability from, this Promotion and Prize Draw.

27. Prizes are non-transferable and there is no cash alternative for the prizes. At the Promoter's discretion another prize of equivalent or greater value may be substituted if in all reasonable circumstances the promoter is unable to offer the intended prize(s).

28. The separate information provided by the Promoter as to how to enter the Competition is an integral part to these terms and conditions.

29.     No purchase necessary for entry into the Competition.

30. All internet connection charges and any other expenses which may be incurred due to entering or winning the Competition are the sole responsibility of the participant.

31. Law and Jurisdiction: The Competition, and these terms are governed by English law and are subject to the exclusive jurisdiction of the English courts.

32. Acceptance of these Terms and Conditions: By participating in the Competition, participants are deemed to have accepted these terms and conditions.
