CAPITAL’S CASH CALL WITH LOTTO PROMOTION: TERMS AND CONDITIONS

The following terms and conditions (“Terms”) together with Global’s (as defined in the Competition Terms and Conditions)  general Competition Terms and Conditions (which can be found at www.capitalfm.com/terms-conditions/competition  (the “Competition Terms and Conditions”) apply to ‘Capital’s Cash Call’ radio promotion (the “Promotion”) which will run from Monday 12th October 2015 to Friday 30th October 2015 across the Capital Network (details of which are given below). The Promotion gives entrants a chance to win cash prizes with their National Lottery Lotto ticket.

By entering into the Promotion you agree to be bound by these Terms.

The promotion is being jointly run by This is Global Limited (“Global”) 30 Leicester Square, London, WC2H 7LA and Camelot UK Lotteries Limited, Tolpits Lane, Watford, Hertfordshire WD18 9RN  (“Camelot”).

Eligibility and Taking Part in the Promotion

1.    In order to be eligible to participate Promotion, you must:
(a)    be a resident of the UK (excluding Northern Ireland & Isle of Man);
(b)    be 16 or over (proof of age may be requested) and eligible to play National Lottery games;
(c)    not be (in addition to the above) an individual named on the Gambling Commission’s National Lottery prohibited play list, an employee of Global, any Camelot Group Company*, or any of their associated, affiliated or subsidiary companies, key subcontractors, their families, agents or any other person(s) connected with the Promotion; and
(d)    have purchased a National Lottery Lotto Ticket (a “Lotto Ticket”) at a National Lottery Retailer or via the National Lottery website for entry into a National Lottery Lotto draw to be held between 3rd October 2015 and 31st October inclusive (each being a “Qualifying Lotto Draw”).
By entering, you acknowledge, accept and agree that if you are a winner, you will have no right to anonymity and the winner will be obliged to take part in publicity.

2.    To participate in the Promotion you must (in addition to satisfying the eligibility criteria listed in paragraph 1 above):  
(a)    have a Lotto Ticket valid for a Lotto draw taking place between Saturday 3rd October 2015 and Saturday 31st October 2015 inclusive;
(b)    have pre-registered your details and unique Lotto Ticket number at www.capitalfm.com between 00:01 on Tuesday 6th October 2015 and 12pm Friday 30th October 2015.  You must have registered before taking part in the Promotion.  The Promotional Period runs from Monday 12th October 2015 until Friday 30th October 2015 inclusive;
(c)    Entrants who have pre-registered must listen to Capital for the secret celebrity to be revealed. There will be a minimum of 98 promotional rounds during the Promotional Period. When the secret celebrity has been revealed within each promotional round, the Capital Programming Team will randomly select and call one registered entrant on the number they have given at capitalfm.com as part of their online entry.
(d)    The randomly selected entrant will be required to give the name of that Promotional Round’s secret celebrity within 15 seconds. Capital reserves the right to provide the randomly selected entrant with further information about the secret celebrity. Should the first randomly selected entrant fail to identify the secret celebrity, all further randomly selected entrants will be given the same information which will have also been broadcast on air.
(e)    The Entrant must give the Capital Programming Team the name of that Promotional Round’s celebrity. A correct answer should be the name given on air, however, an alternative name will be accepted, as long as it is a name the celebrity is commonly known or clearly identified by. The Capital Programming Team’s decision is final. Should an incorrect answer have already been received, the randomly selected entrant will be given this information in advance of them answering the question. If the Entrant gives the correct answer, they will be required to pre-record a telephone conversation with a Capital presenter which may be broadcast on air during which they will be awarded the prize. Fulfilment of the prize is subject to the Entrant’s Lotto ticket being validated by Camelot UK Lotteries Ltd after the promotional round is completed.
(f)    If the Randomly Selected Entrant is incorrect, Capital will go to the next randomly selected Entrant. For each Competition Round, maximum of 20 randomly selected entrants will be called until the correct answer is given. All randomly selected entrants will be given the same information and any incorrect answers which have already been received. If the secret celebrity is not identified within a Competition Round, the prize will not be awarded.  If the prize is not awarded it will be forfeited and the prize money will be used for an additional Promotional Round during the Promotional Period.

Each Lotto Ticket can only be entered once during the Promotional Period. Please note that your Lotto Ticket number will be checked to ensure it is a valid number.  This verification will take place after on air winner announcement, your prize will be forfeited if you have not provided a valid Lotto Ticket number during registration.  You must keep your original Ticket or printed validation slip as proof of purchase – this may be required before any prize is awarded.

If you are a member of a syndicate: If the Ticket was purchased on behalf of a syndicate, it is the responsibility of the members of the syndicate to decide who will enter the Promotion and how any prize won may be shared. A prize will only be paid to the person who has registered their details to enter the Promotion.  Entrants’ addresses will be verified.
Entries not complying with these Terms will be disqualified.

3.    Internet access is required to enter the Promotion.

4.    Number of entries: Players are only required to register once online at www.capitalfm.com. This will remain valid throughout all Promotional Rounds during the Promotional Period.

5.    Entries using methods such as a macro, a script or the use of automated devices or processes are not allowed and all such entries will be disqualified. Incomplete, corrupt or entries not in accordance with entry instructions will not be accepted. No responsibility is accepted for entries lost, damaged or delayed as a result of any network, computer hardware or software failure of any kind.
The Promotion Rounds, Promotional Draw and Prizes

6.    There will be a minimum of 98 (ninety eight) Promotional Rounds held during the 3 (three) week Promotional Period. The Promotional Rounds will be broadcast at random times. Additionally there is one online promotional draw (“Promotional Draw) at the end of the Promotional Period which will give all registered entrants a further opportunity to win a prize.  The table below sets out the entry mechanic and the Qualifying Lotto Draws (also referred to in paragraph 2).

7.    Participating Stations: The Capital Network is made up of the following Capital FM stations: Capital FM London, Capital FM Birmingham, Capital FM East Midlands, Capital FM Manchester, Capital FM North East, Capital FM Scotland, Capital FM South Coast, Capital FM South Wales, Capital FM Yorkshire, Capital FM North West & North Wales and Capital Cymru.

8.    The Promotional Rounds: The ‘winner’ of each Promotional Round will be randomly selected by Global from all pre-registered entrants. They will then be called back by the Global Production Team off air. All ‘winners’ will need to confirm, before they go on air, that they have pre-registered with a valid Lotto Ticket number and that they still have their Lotto Ticket or validation slip.  At the end of each day during the Promotional Period, all winners of that day’s Promotional Rounds will have their Lotto Ticket numbers verified to ensure that it is valid and for a Qualifying Lotto Draw.  If the Lotto Ticket number is not valid, the prize will be forfeited and the prize money will be used for an additional Promotional Round during the Promotional Period.

9.    The Promotional Draw: Following successful entry in accordance with the above entry criteria, all entries will be automatically entered into a random prize draw. The draw will take place on Friday 30th October. At least twice the amount of names in relation to winners will be drawn to allow for reserve winners.  

10.    The prizes: There is a total of £500,000 (five hundred thousand pounds) to be won across the Promotional Period.  There will be a minimum of 98 (ninety eight) Promotional Rounds with each Promotional Round offering one £5,000 (five thousand pound) prize.  Additionally there is one online Promotional Draw where one entrant will win a prize of £10,000 (ten thousand pounds).
Winners

11.    Promotional Rounds:  During the promotional period the randomly selected entrants will be contacted (via the contact telephone number provided upon entry) by a representative of Capital FM advising them they have been randomly selected, and they will be asked for that hour’s secret Celebrity. Once this has been established, they will be required to pre-record a telephone call with a Capital presenter, which may then be played out on air. If the winner fails to answer their telephone when Capital FM attempt to call or the telephone call is disconnected at any time before or during for any reason, the Promoters reserve the right to offer the prize to another entrant (selected at random). Upon successful verification of their unique Lotto ticket number, winners of the Promotional Rounds will be sent a cheque within 28 days of the end of the Promotional Period. For the avoidance of any doubt, this is within 28 days from Friday 30th October 2015.

12.    Promotional Draw: The winner of the online Promotional Draw must be available between 12:00 and 15:00 on the afternoon of Friday 30th October 2015 to receive a telephone call (via the contact telephone number provided upon entry) from a representative of Capital FM advising the winner of their prize. They then may be required to pre-record a telephone call with a Capital presenter, which may be played out on air.

13.    If the winner fails to answer their telephone when Capital FM attempt to telephone or the telephone call is disconnected at any time before or during for any reason, the Promoters reserve the right to offer the prize to another entrant (selected at random). Upon successful verification of their unique Lotto ticket number, the winner of the online Promotional Draw will be sent a cheque within 28 days of the end of the Promotional Period.  For the avoidance of any doubt, this is within 28 days from Friday 30th October 2015.

14.    All winners’ details will be passed on to Camelot and Camelot will fulfil the prize. If a winner cannot be contacted within 28 days of the initial attempted contact by Camelot; the Promoters reserve the right to offer the prize to another entrant (selected at random).

15.    All winners may be required to go on air, this will be in the form of a telephone call with a Capital FM presenter, giving the name of the secret celebrity and congratulating the entrant on their winning moment.     

16.     You can only win once throughout the Promotional Period. Winners of a Promotional Round will not be eligible to win any further Promotional Round and will be also not be eligible to win the online Promotional Draw.
 GENERAL

17.    All personal data provided to Global and/or Camelot, during entry or otherwise in relation to the Promotion, will be processed in accordance with the Data Protection Act 1998 (the “DPA”). Personal data will be held and used by Global and Camelot for the purposes set out in these Terms. Unless you have opted out at the time of entry, your personal data will also be used by Camelot to send you marketing and promotional messages about The National Lottery and its games. Your personal data may be transferred to countries outside of the European Economic Area which may not have laws which offer similar protection to that offered to you under the DPA and you consent to such transfer and to the processing of your personal data in such countries.

18.    Global and Camelot’s’ decisions will be final and no correspondence will be entered into.

19.    Neither Global nor Camelot accepts any liability or responsibility of any nature for any action or event which prevents a person from entering into the Promotion, nor in relation to the taking of any prize or the consequences of doing so, to the extent permitted by law. Further, neither Global nor Camelot shall be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, digital connectivity, fire, flood, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.

20.    Global and Camelot reserve the right to cancel this Promotion or to vary the Promotion or these Terms at any time by giving notice (on www.capitalfm.com or otherwise).

*Camelot Group of Companies means Camelot UK Lotteries Limited, Camelot Business Solutions Limited, Camelot Strategic Solutions Limited, Camelot Global Services Limited and Camelot Commercial Services Limited, all companies registered in England with registered address at Tolpits Lane, Watford, Hertfordshire, WD18 9RN.
