RULES - CHARITY AUCTION EVENT

The following rules (“Rules”) together with Global Radio Services Ltd's ("Global Radio") general and competition terms and conditions (with the specific exception of clauses 2.1 to 2.6) (the “Terms and Conditions”) (which can be found at http://www.capitalfm.com/terms-conditions/competition/ and Ebay’s user agreement  (which can be found at http://pages.ebay.co.uk/help/policies/user-agreement.html) apply to Capital South Coast’s  appeal for Help a Capital Child (“the Charity Auction”) which will run from  Sunday 10th June 2012 at 9.30am  to Friday 15th June 2012  at 9.30am(“the Duration”).

By participating in the Charity Auction, anyone who takes part (“a Participant”) will be deemed to have understood these Rules along with the Terms and Conditions and to be bound by them.

  • 1. Details of the Auction
    • 1.1 Throughout the Duration, listeners to the Participating Radio Station will be invited to take part in the Charity Auction week by making a donation and/or, bidding for and/or purchasing items.
    • 1.2 There will be two different ways to participate in the Charity Auction. During the Duration, each Participant must go online to www.capitalfm.com/southcoast// (“the Online Auction”) and give full contact details through a valid Ebay account as required by the Participating Radio Station and Ebay (including, without limitation, full name, address, email, and telephone number(s)) to take part in one or more ways:
      • 1.2.1 By making direct donations online (“Donations”);
      • 1.2.2 By placing bids online through Ebay throughout the week on items (“Charity Bid”).
  • 1.3 For any Charity Bid, Participants must place a bid online via ebay.co.uk  from Sunday 10th June at 9.35am  until the item closes at 9.35am on Friday 15th June.  
  • 1.4 With regards to the Charity Bid, once the item is open online bids will be taken for a specific period as announced online and on air (“Bid Period”). The auctions will be run according to the terms and conditions of Ebay.  Where a Charity Bid is successful, the Participant will be contacted by the Participating Radio Station and Ebay.
  • 1.5 All Participants must ensure that they are able to pay for any item on which they wish to bid for or purchase or that alternatively, they can afford to give the Donation.
  • 1.6 Payment for any Donation or Charity Bid must be by PayPal, debit or credit card.
  • 1.7 With regards to any Charity Bid, no contract shall have been entered into between the Participating Radio Station and the Participant unless the amount to be paid has been deducted from and/or charged to the Participant’s bank account and the items in question have been dispatched to the Participant.
  • 1.8 Title in any Charity Bid items successfully bid for shall not pass to the Participant until payment for such item has been received by the Participating Radio Station and delivery to the Participant has taken place.
  • 1.9 Delivery of Item(s) with prize details will be made within 28 (twenty eight) days to the address specified by the Participant. Please note deliveries will only be made to addresses within England, Scotland, Wales and Northern Ireland. Upon delivery, risk of damage to or loss of the Item(s) shall pass to the Participant concerned. The Participating Station reserves the right to require photo ID from any or all Participant(s) before delivering any or all Item(s) to such Participant(s).
  • 1.11 All matters relating to the Charity Auction shall be at the sole discretion of the Participating Radio Station and Global Radio.
  • 2. Eligibility
    • 2.1 Participants must be 18 years of age or over on the date of the auction or donation in question.
    • 2.2 Notwithstanding that a winning bid has been received or a pledge for an Item(s) has been given, if the Global Radio and/or the Participating Radio Station discover that for any reason under these Rules or Terms and Conditions the Participant was ineligible to make a Donation, and/or engage in the Charity Bid, or that any of the same should have been declared invalid due to any suspect activity (in the sole discretion of Global Radio and/or the Participating Radio Station), the Global Group reserves the right to reject the Donation, winning Charity Bid purchase as applicable. In such circumstances, Global Radio reserves the right to offer the Item(s) to another bidder (in the sole discretion of Global Radio and/or the Participating Radio Station).
    • 2.4 The owner of the credit/debit card must personally provide his/her credit/debit card details or pay through PayPal on the Ebay.
    • 2.5 Global Radio and the Participating Radio Station shall not be responsible for any failure on behalf of any Participant whose bid is not received by Ebay, Global Radio and/or the Participating Radio Station.
  • 1.10 All Item(s) offered for the Charity Bid shall be subject to availability and the Participating Radio Station shall not be liable for claims, expenses, costs and or any losses (such as but not limited to profits, indirect, pure economic, consequential or otherwise) or damage (save for death or personal injury arising from negligence) suffered by any Participant(s).
